The Beautiful Game

Football is rarely out of the insolvency news these days, with several managing to stave off winding up petitions at the eleventh hour and Glasgow Rangers and Portsmouth being just the latest in a long line of clubs to be put into administration and with Port Vale, by all accounts, about to follow.

One of the unique features of football insolvency is the so-called “football creditors rule”, which results in other clubs, players and various football organisations being paid in priority to other creditors. HMRC is challenging the rule in the Courts but for the moment, at least, it stands. As contacts regularly ask how the football authorities manage to get away with it, we thought you might be interested in the explanation in the attached note (with apologies if you’re not in the least bit interested in the “beautiful game”).
